Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of Bugsink (“Software”), a self-hosted error tracking system provided by Bugsink B.V. (“Company”). By installing or using the Software, you (“Customer”) agree to these Terms.

License and Use

  • The Software is provided under a subscription license as agreed upon at the time of purchase.
  • Usage is limited to the number of users covered by the purchased license.
  • Production use requires a valid subscription for the correct number of users.

Production Use

Production use is defined as deploying the Software to monitor or track errors in applications that are used by end-users in a live environment. Non-production use, such as testing or evaluation, is restricted to a single user and must not violate the terms outlined here.

Restrictions

  • You may not resell, sublicense, or distribute the Software.
  • Modifying the Software is allowed only if the copyright and license notices remain intact, and the modifications do not conflict with these Terms.
  • You may not reverse engineer, decompile, or disassemble the Software unless explicitly allowed by applicable law.
  • Use of the Software must comply with all applicable laws and regulations.

Ownership

  • Bugsink retains all ownership and intellectual property rights to the Software.
  • Feedback provided by Customers may be used to improve the Software, but does not grant any ownership rights to the Customer.

Updates and Support

  • Updates to the Software may be provided during the license term.
  • No technical assistance is offered during installation.

Data Collection and Privacy

  • The Software periodically sends “phone-home” messages to Bugsink servers. These messages include metadata about usage, deployment settings, and license information. Details about data collection are outlined in our Privacy Policy.
  • Error events and other data remain on your self-hosted instance. Bugsink B.V. does not access or store this data.

Warranty Disclaimer

  • The Software is provided “as-is,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • The Company is not liable for issues arising from improper installation, misuse, or unauthorized modifications of the Software.

Liability Limitation

  • The Company’s total liability is limited to the amount paid for the license in the preceding 12 months.
  • The Company is not responsible for indirect, incidental, or consequential damages.

Term and Termination

  • These Terms remain in effect as long as you use the Software.
  • The Company may terminate the license if these Terms are violated.
  • Upon termination, you must cease using the Software and delete all copies.

General

  • These Terms are governed by the laws of the Netherlands.
  • Any disputes will be resolved in Dutch courts.
  • If any part of these Terms is deemed invalid, the remaining provisions will remain in effect.

By using Bugsink, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not install or use the Software.
